Energiefraude – administratieve geldboete opgelegd door VEKA

In een interessant arrest van 25 april 2024 oordeelde de Raad van State dat de administratieve geldboete die het VEKA kan opleggen in het geval van energiefraude een strafrechtelijk karakter heeft. Daarom kan het die boete niet opleggen voor feiten die dateren van voor de inwerkingtreding van art. 13.4.11 Energiedecreet op 1 juni 2017. De (vermeend foutieve) aanmelding van de ingebruikname van een PV-installatie (en het AREI-verslag waarop die aanmelding steunde) die dateert van voor die datum kan dus niet onderworpen worden aan een administratieve geldboete.

Geen zichzelf respecterend “groot kantoor” wil een inkomstenboot missen, zeker niet wanneer het de nieuwe regels zijn die het werk creëren.
